I'd say so. Existing precedent and case law meant that most accident management companies wouldn't give you anything special unless you could (loosely) justify why you need something fancier than a "standard" car. In addition, if you had access to an alternative vehicle then there is little chance of getting a hire.

I'm surprised at how this case was taken on. Rulings seem to swing backwards and forwards for this type of case. It looks like the current trend has opened the flood gates. What does this mean? You're more likely to get a car similar to yours if you have a non-fault accident without having to justify why you deserve it.
